GENOWSTUDIO ONLINE STORE REGULATIONS

§1. General provisions

  1. These regulations (hereinafter referred to as the “Regulations”) define the rules for concluding and performing sales agreements in the online store www.genowstudio.com, as well as the rights and obligations of the parties to these agreements.

  2. The online store www.genowstudio.com (hereinafter referred to as the “Store”) is operated by:
    “Pracownia projektowo-krawiecka Julia Kolasa”, based in Kraków, ul. Cechowa 77, 30-685, registered in the Central Registration and Information on Business (CEIDG), NIP: 6793193059, REGON: 384976261 (hereinafter referred to as the “Seller”).

  3. The Seller’s business activity consists of retail sales of physical and digital products (together, the “Products”).

  4. Contact with the Store is possible via:
    a) e-mail address: genowstudio@gmail.com
    b) contact form available on the Store website

  5. The Store enables:
    a) obtaining information about Products available in the Store;
    b) submitting purchase offers by persons registered in the Store (hereinafter referred to as “Buyers”) or making purchases without registration

  6. Information about Products, including descriptions and prices, does not constitute an offer within the meaning of the Civil Code, but is an invitation to make a purchase offer (“Order”).

  7. Registration in the Store constitutes acceptance of the Regulations.

  8. To use the Store, it is necessary to have:
    a) an active e-mail account
    b) Internet access
    c) a standard web browser

  9. The Seller is not responsible for:
    a) disruptions in the Store's operation caused by force majeure, actions of third parties, or incompatibility of the Buyers’ systems
    b) non-delivery or delay of orders caused by providing incorrect data by the Buyer
    c) blocking or deleting e-mails by server administrators or the Buyer’s software

  10. The Buyer may not make purchases anonymously or under a pseudonym.

  11. It is forbidden to send illegal content via the Store's forms.


§2. Definitions

  1. Buyer – a natural person, legal person, or organizational unit without legal personality making a purchase in the Store

  2. Civil Code – the Act of April 23, 1964 (Journal of Laws 1964.16.93)

  3. Consumer – a natural person entering into a sales agreement not directly related to business or professional activity

  4. Regulations – these regulations

  5. Store – the online store operating at www.genowstudio.com.

  6. Business Days – days from Monday to Friday, excluding statutory public holidays

  7. Seller – Julia Kolasa, conducting business under the name “Pracownia projektowo-krawiecka Julia Kolasa”, ul. Cechowa 77, 30-685 Kraków, registered in CEIDG, NIP: 6793193059, REGON: 384976261


§3. Electronic services

  1. The online store www.genowstudio.com provides electronic services to Buyers in accordance with the Act of 18 July 2002 on the provision of electronic services.

  2. The electronic services provided by the Seller include in particular:
    a) enabling browsing the Store's offer and placing Orders
    b) enabling registration and managing a user account in the Store
    c) sending commercial information and notifications related to orders
    d) selling and providing digital products (e.g., downloadable files)

  3. The provision of electronic services is free of charge. Only sales agreements for physical and digital products concluded via the Store are paid.

  4. The electronic service agreement is concluded when the Buyer starts using the Store (e.g., visiting the website, creating an account, or placing an order).

  5. The account management agreement in the Store is concluded for an indefinite period and may be terminated by the Buyer at any time by deleting the account or sending a statement to genowstudio@gmail.com.

  6. The Seller reserves the right to temporarily suspend electronic services due to technical maintenance, striving to make such interruptions as short as possible.

  7. Using electronic services involves typical Internet risks, such as the possibility of unauthorized access to users’ data or system infection with malicious software. The Seller recommends using up-to-date antivirus software and exercising caution.

  8. The Seller uses cookies for the proper functioning of the Store, content personalization, and traffic analysis. Detailed rules are described in the Store’s Privacy Policy.


§4. Placing an order

  1. An order can be placed as a registered customer or guest.

  2. The Buyer selects products, proceeds to the cart, provides shipping data, chooses a payment method, and accepts the Regulations.

  3. After payment, the Buyer receives confirmation on the Store website.

  4. The sales agreement is concluded at the moment of placing the order and confirming the payment.

  5. The Buyer provides accurate personal data; in case of incorrect data, the Seller may suspend order fulfillment.

  6. Digital products are delivered immediately after payment is credited or within the timeframe specified in the product description.


§5. Prices and payments

  1. All prices are final. The Seller is exempt from VAT.

  2. Prices do not include delivery costs, which depend on the delivery method, carrier, product weight, and order value. The total price is provided before clicking “Buy and Pay.”

  3. Online payments are processed securely via Shopify Payments.
    Available payment methods include:

    • Credit and debit cards: Visa, Mastercard, American Express, Maestro, UnionPay

    • Digital wallets: Apple Pay, Google Pay

    • Local payment methods (Poland): BLIK, Klarna

    • PayPal

    • Cash on Delivery – payment in cash directly to the courier upon delivery of the order


§6. Delivery

  1. Physical products are delivered by Poczta Polska courier service for international orders, and by InPost parcel lockers or courier within Poland.

  2. The Buyer selects the delivery method via the Store form.

  3. The Buyer bears the delivery cost, unless the Store indicates otherwise.

  4. The Seller may divide the order into several shipments at no additional cost.

  5. Delivery time for physical products: up to 3 Business Days from dispatch.

  6. Digital products are delivered immediately after payment is credited.


§7. Order fulfillment

  1. Order fulfillment includes assembling physical products, packing, and dispatching the shipment.

  2. The order is considered fulfilled upon dispatch of the shipment or provision of digital files.

  3. In the case of products with different fulfillment times, the fulfillment time for the entire order is the longest among the products; the Seller may propose order splitting.


§8. Right of withdrawal

  1. The right applies only to consumers.

  2. The Consumer may withdraw from the contract within 14 days of receiving the shipment (physical products) without giving any reason.

  3. The right of withdrawal does not apply to products:
    a) made to order
    b) personalized
    c) digital products that have been delivered (made available for download or sent by e-mail) with the Consumer’s explicit consent before the withdrawal period expires and after being informed of the loss of this right

  4. To exercise the right of withdrawal, the Consumer must return the purchased product along with the completed return form within 14 days of receiving the Product to the address provided by the Seller.

  5. The Consumer bears the cost of returning the product.

  6. The Consumer is responsible for any decrease in product value resulting from use beyond what is necessary to establish the nature, characteristics, and functioning of the product.

  7. The Seller refunds payments within 14 days of receiving the statement and the product (if applicable).


§9. Personal data protection and privacy policy

  1. The rules for processing personal data and cookies are described in the Store’s Privacy Policy.


§10. Intellectual property

  1. The Store’s content is protected by copyright.

  2. Physical products may not be copied or distributed for commercial purposes.

  3. Digital products may only be used for personal purposes; further distribution, sale, or publication is prohibited.


§11. Complaints and warranty

  1. The Seller is liable for product defects in accordance with the Civil Code (Articles 556–576).

  2. Complaints should be submitted in writing or by e-mail to genowstudio@gmail.com.

  3. The complaint should include: Buyer’s data, precise product identification, proof of purchase, defect description, Buyer’s request, date, and signature.

  4. The Seller responds to complaints within 14 days. Failure to respond within this period is considered acceptance of the complaint.

  5. The Seller may refuse to accept a complaint in the case of a minor defect or one resulting from the nature of the material or not following usage instructions.


§12. Out-of-court dispute resolution

  1. Detailed information on out-of-court dispute resolution is available at the offices and websites of district/city consumer ombudsmen, social organizations dealing with consumer protection, Regional Trade Inspection Offices, and UOKiK websites:

§13. Final provisions

  1. The Seller applies the Code of Ethics of the National Chamber of Commerce as in force on the date these Regulations come into effect.

  2. The Seller may change the Regulations at any time without the Buyers’ consent, while preserving acquired rights.

  3. Buyers are informed of changes to the Regulations via announcement on the Store website and e-mail at least 10 days before the changes take effect. Failure to object means acceptance of the changes.

  4. All product names, descriptions, and logos of individual brands are used for identification purposes and are protected under the Industrial Property Law.

  5. The Regulations are available on the Store website, downloadable and printable.

  6. The Seller reserves the right to change prices, promotions, and the Regulations without affecting acquired rights.

  7. Matters not regulated by these Regulations are governed by Polish law, in particular the Civil Code, the Consumer Rights Act, and the Act on the provision of electronic services.

  8. In the event of disputes arising from sales agreements concluded in the Store, Polish law shall apply. The Regulations are drafted in Polish, and translations into other languages are for informational purposes only.
